Settle California Personal Injury Claims Through Mediation Services

Navigating the aftermath of a personal injury can be a daunting experience, especially if you are hesitant to engage in a lengthy legal battle. Depending on the circumstances, alternative dispute methods like mediation and arbitration can be effective in settling injury disputes.

Suppose you prefer to engage in alternative dispute resolution to address your injury matters. In that case, I am open and able to help you explore this option. As the lead attorney at Bianco Law Firm, LLP, I am one of the growing number of personal injury lawyers using mediation and arbitration to resolve personal injury disputes. Let’s discuss how we can achieve a satisfactory resolution to your claim. Whether you’re in the Bay Area, Northern California or San Diego, I am here and ready to assist you.

What Is Mediation?

Mediation is a form of alternative dispute resolution (ADR) where two parties meet with a third party, the mediator, to hash out their dispute and reach a mutually agreed upon solution to settle their issues. The process is confidential and can often save more time and money than in a traditional court case.

In the context of a personal injury case, both parties sign a confidentiality agreement and provide initial statements about their perspective of the situation. Then, the mediator speaks privately with both parties about their initial interaction. After further discussions and sessions, either both parties reach an agreement and their case is resolved, or they don’t reach a deal and their case goes back to court.

What Is Arbitration?

Arbitration is similar to mediation in that both parties try to settle matters out of court to save time and money. However, both parties present their perspective on the injury case with arbitration. Then, a third party, known as the arbitrator, can determine who they think is at fault and, in some cases, choose a settlement amount they believe is appropriate.

As a certified mediator and arbitrator, I can handle both of these proceedings effectively. My empathetic approach is particularly beneficial in these settings, where understanding and addressing the needs of both sides is paramount. I tailor my approach during mediation and arbitration to help you effectively resolve these matters.

When Is Mediation Or Arbitration The Right Option For You?

ADR can be a viable option if:

  • You need to figure out who is most at fault for your injury.
  • The settlement amounts you’re disputing are only worth a few thousand dollars.
  • You don’t have much more to negotiate for in your injury settlement.

These questions can be challenging to address on your own. I can help you evaluate your current circumstances if you feel unsure.
