What Is Mediation?
Mediation is a form of alternative dispute resolution (ADR) where two parties meet with a third party, the mediator, to hash out their dispute and reach a mutually agreed upon solution to settle their issues. The process is confidential and can often save more time and money than in a traditional court case.
In the context of a personal injury case, both parties sign a confidentiality agreement and provide initial statements about their perspective of the situation. Then, the mediator speaks privately with both parties about their initial interaction. After further discussions and sessions, either both parties reach an agreement and their case is resolved, or they don’t reach a deal and their case goes back to court.
What Is Arbitration?
Arbitration is similar to mediation in that both parties try to settle matters out of court to save time and money. However, both parties present their perspective on the injury case with arbitration. Then, a third party, known as the arbitrator, can determine who they think is at fault and, in some cases, choose a settlement amount they believe is appropriate.
